1.35 NO TRESPASS ORDERS

Effective: November 19, 2025

Purpose: This policy aims to provide for issuance of No Trespass Orders (NTOs), which exclude individuals from campus and campus activities, while ensuring compliance with due process rights for students, employees, and visitors at the University and to safeguard the welfare of the University community while upholding principles of fairness and due process for all individuals involved.

Scope: This policy applies to all individuals on University premises, including students, faculty, staff, visitors, and contractors.

Policy Statement: Campus No Trespass Orders may be issued at the discretion of the University Administration or their designated authorities, based on, but not limited to, the following grounds:

  • Violation of University policies or regulations
  • Threat to the safety or well-being of individuals on campus
  • Disruption of University activities
  • Illegal activities conducted on campus premises

Issuance of No Trespass Orders

The issuance of Campus No Trespass Orders shall be authorized by the University Administration or their designated authority. Orders shall be in writing, specifying the basis for exclusion, the duration of the order, and any conditions for reinstatement. Verbal notice of a no trespass order shall be sufficient notice for NTO’s, but written notice of the order shall be provided to the individual subject to exclusion from campus and campus activities, including the reasons for the decision, as soon as practicable.

Duration

No Trespass Orders shall specify the duration of the order, determined based on the circumstances and severity of the violation. The University reserves the right to extend or modify the duration of the order as necessary. A No Trespass Order may be issued with a duration of "until further notice.”

Reinstatement

Individuals subject to No Trespass Orders may request reinstatement following the completion of the specified duration or upon meeting conditions outlined in the Order. Requests for reinstatement shall be submitted to the designated authority, who shall review the request and make a determination.

Compliance

Failure to comply with a No Trespass Order may result in further disciplinary action, including suspension or expulsion for students and termination of employment for employees. Additionally, individuals who fail to comply with No Trespass Orders may be removed from campus and subject to criminal prosecution.

Confidentiality

Information related to campus No Trespass Orders shall be treated as confidential in accordance with applicable laws and regulations.

Definitions:

Campus Activities – This term includes events University related activities that take place outside the geographic limits of Emporia State University’s physical campus but that take place at locations or spaces controlled by the University and that the University has the right to limit or exclude individuals.

No Trespass Order (NTO) - A directive issued by University Administration or designated authority, temporarily barring an individual from campus premises.

Procedures: All procedures linked and related to the policies above shall have the full force and effect of policy if said procedures have first been properly approved by the University’s administrator in charge of Student and Student Life.
