Definitions

  • Sexual Violence or Sexual Assault means any physical act which is sexual in nature that is committed by force, coercion, intimidation, manipulation, incapacity, or without the full and informed consent of all persons involved.
  • Intimate Partner Violence (Dating/Domestic Violence) means violence or threat of physical act, including physical violence, damage to property, or other act, between individuals who are in a relationship of a romantic or sexual nature, that causes a member of that relationship to fear for their physical safety.
  • Stalking means a course of conduct targeted at a specific person which would cause a reasonable person to fear for their safety, and the targeted person is placed in such fear.
  • Sexual Harassment means behavior, including physical contact, advances, and comments in person, through an intermediary, and/or via phone, text message, email, social media, or other electronic medium, that is unwelcome; based on sex or gender stereotypes; and is so severe, pervasive, and objectively offensive that it has the purpose or effect of substantially interfering with a person’s academic performance, employment, or equal opportunity to participate in or benefit from University programs or activities or by creating an intimidating, hostile, or offensive working or education environment.
  • Non-consensual Sexual Contact (Sexual Misconduct) means any unwelcome behavior of a sexual nature that is committed without consent or by force, intimidation, coercion, incapacitation, or manipulation.
  • Consent is freely and affirmatively communicated willingness to participate in sexual activity. It is the responsibility of the initiator of the sexual activity to ensure that person has the other person’s consent to engage in any sexual activity.
  • Incapacitation means the inability to give consent because of age, physical condition, disability that impairs the individual’s ability to provide consent. Reasons one could lack capacity to give consent due to physical condition includes, but is not limited to, consumption of drugs or alcohol (voluntarily or involuntarily) or being in a state of unconsciousness, sleep, or other state in which the person is unaware that sexual activity is occurring.
  • Retaliation means material adverse action taken against any individual for reporting, providing information, exercising one’s rights or responsibilities, or otherwise being involved in the process of responding to, investigating, or addressing allegations of misconduct.
  • Complainant is the complaining party in any Title IX matter; the person who asserts they have experienced behavior contrary to university sexual misconduct policy.
  • Respondent is the responding party in any Title IX matter; the person alleged to have violated university sexual misconduct policy.
